{"id":854,"date":"2019-08-05T16:02:48","date_gmt":"2019-08-05T20:02:48","guid":{"rendered":"https:\/\/mc2avocats.com\/?p=854"},"modified":"2024-01-28T17:41:48","modified_gmt":"2024-01-28T21:41:48","slug":"bill-on-prostitution","status":"publish","type":"post","link":"https:\/\/votredefense.com\/en\/bill-on-prostitution\/","title":{"rendered":"Bill on Prostitution\u00a0"},"content":{"rendered":"<p><strong>Bill on Prostitution\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Since December 2014, the government, through Bill C-36 &#8211; <\/span><i><span style=\"font-weight: 400;\">Protection of Communities and Exploited Persons Act<\/span><\/i><span style=\"font-weight: 400;\"> has decriminalized the act, but has criminalized the purchase of this service.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This follows a ruling by the Supreme Court of Canada that gave the government a one-year delay in bringing forward legislative amendments that would ensure greater security for sex workers.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong>New Features of the Bill on Prostitution<\/strong><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Under section 286.1 of the <\/span><i><span style=\"font-weight: 400;\">Criminal Code<\/span><\/i><span style=\"font-weight: 400;\">, it is forbidden, in any place, to obtain sexual services for remuneration or to communicate for that purpose.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Under section 286.4 of the <\/span><i><span style=\"font-weight: 400;\">Criminal Code<\/span><\/i><span style=\"font-weight: 400;\">, it is prohibited to knowingly engage in advertising for the purpose of offering sexual services for compensation.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Under section 286.2 of the <\/span><i><span style=\"font-weight: 400;\">Criminal Code<\/span><\/i><span style=\"font-weight: 400;\">, it is prohibited to obtain a material benefit, including pecuniary, that originates or was obtained from the commission of the offense relating to the purchase of sexual services.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Under section 286.3 of the <\/span><i><span style=\"font-weight: 400;\">Criminal Code<\/span><\/i><span style=\"font-weight: 400;\">, it is forbidden to induce a person to offer or render sexual services for remuneration or, in order, to facilitate the offense of obtaining sexual services for remuneration, to recruit, detain, hide or harbour a person who offers or renders sexual services for remuneration, or exercises control, direction or influence over the movements of such a person.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In all cases, persons who offer their own sexual services for a fee have immunity from prosecution for the commission of these offenses, when the only benefit comes from the sale of their own sexual services.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Controversy Related to the Bill on Prostitution<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">This bill is not unanimous, some experts and pressure groups representing sex workers already plan to ask for amendments considering that this bill will push sex workers to the street.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">If you face charges related to prostitution<\/span><span style=\"font-weight: 400;\">.
